FISHERMANSLODGE
These payment and cancellation conditions govern the contractual agreements between the end customer and the FISHERMANS-LODGE booking platform (hereinafter referred to as ‘platform’) as well as between the platform and the landlord or service provider or equipment rental company.
1.1. Terms of payment towards the end customer
Down payment
The end customer undertakes to pay a deposit of 17% of the final rental price, whereby the services to be provided (e.g. final cleaning) have already been deducted. The deposit is due immediately upon completion of the booking.
Main Booking
The main payment amounts to the remaining 83% of the total price, plus the services and taxes due. The main payment must be made at least 4 weeks before the start of the holiday. If the booking is made less than 4 weeks before the start of the holiday, the main payment is due immediately.
Payment Methods
All payments must be made by bank transfer, credit card or other payment methods accepted by the platform. The exact payment methods will be communicated to the end customer at the time of booking.
Due date and interest on arrears
Payments due must be made within the specified deadlines. In the event of late payment, the end customer is obliged to pay interest on arrears at a rate of 5% above the respective base rate of the European Central Bank, unless the end customer can prove that no or less damage has been incurred.
1.2 Terms of payment to the lessor
Down Payment
The down payment of 17% of the end customer price corresponds to the platform's service fee and is retained by the platform.
Main Payment
The main payment of the end customer shall be transferred to the account of FISHERMANS-LODGE Lars Hahne, where it shall be kept safely until the contractual obligations have been fulfilled. The payment will be transferred to the landlord no later than 14 days after the start of the holiday. With the payment of the main payment to the landlord, all cancellation claims of the end customer expire, as the payment is regarded as confirmation of the fulfilment of the contract.
2.1 Terms of payment to the end customer
Down payment
The end customer undertakes to make a down payment of 17% of the total price for the booked services or hired equipment. The deposit is due immediately upon completion of the booking.
Principal payment
The main payment amounts to the remaining 83% of the total price, plus the applicable services and taxes. The main payment must be made at least 4 weeks before the date of utilisation of the service or the rental period. If the booking is made less than 4 weeks before the date, the main payment is due immediately.

3.1 Cancellation by the end customer
Cancellation period and cancellation costs
The end customer can cancel the booking at any time before the start of the trip. In the event of cancellation, the following cancellation costs apply, which are calculated on the total price of the booking (including all services):
Cancellation must be made via the platform and the button provided for this purpose in the advertisement, whereby the date of receipt of the cancellation declaration is decisive.
Partial cancellation
Partial cancellation of individual services is possible.
Refund
In the event of timely cancellation, any remaining amount (after deduction of cancellation costs) will be refunded to the end customer within 14 days of cancellation.
3.2 Cancellation by the provider or the platform
Cancellation due to late payment
The provider or the platform is entitled to cancel the booking without further notice if the end customer does not make the payments due within the agreed deadlines. In this case, the cancellation costs specified in Section 1 shall apply. The booking period will be released again after cancellation.
Cancellation for unforeseeable reasons (force majeure)
The provider or the platform is entitled to cancel the booking if the provision of the agreed services becomes impossible due to unforeseeable events (force majeure), such as natural disasters, wars, pandemics or other exceptional circumstances. In this case, the end customer shall receive a full refund of any payments already made. The end customer shall have no further claims, in particular claims for damages.
Cancellation for good cause
The provider or the platform can also cancel the booking for good cause if special circumstances justify this, e.g. in the event of gross violations of the General Terms and Conditions (GTC) or the house rules by the end customer. In this case, the provider retains the right to cancellation costs in accordance with section 1.
3.3 Special regulations
Cancellation free of charge
In certain cases, free cancellation can be agreed, e.g. for flexible rate options that expressly allow free cancellation up to a certain date. Such exceptions must be explicitly stated in the booking contract.
Cancellation due to travel warnings
If there is an official travel warning from the Federal Foreign Office for the region of the booked accommodation at the time of departure, the end customer is entitled to cancel the trip free of charge. In this case, the end customer will receive a full refund of any payments already made.
3.4 Rebooking and transfer of the booking
Rebooking
At the request of the end customer, the booking can be rebooked up to 30 days before departure for a processing fee of EUR 50. However, this requires the consent of the provider and the availability of the new date. In the case of short-term rebookings, the cancellation conditions in section 1 apply.
Transfer of the booking
The end customer is entitled to transfer his/her booking to another person, provided that this person fulfils the contractual conditions. A processing fee of EUR 50 will be charged for the transfer. The transfer must be notified at least 7 days before the start of the holiday.
3.5 Final provisions
Applicable law and place of jurisdiction
German law shall apply. The place of jurisdiction for all disputes in connection with these Cancellation Terms and Conditions shall be the registered office of the FISHERMANS-LODGE booking platform.
Severability clause
Should individual provisions of these cancellation conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.
Default of payment
If the end customer defaults on payment, both the provider and the platform are entitled to take all legally permissible measures to enforce the claim. This includes in particular the assertion of damages caused by default and the initiation of dunning procedures.
Cancellation in the event of non-payment
If payment is not made within the agreed deadlines, the provider and the platform are entitled to cancel the booking or reservation of the accommodation without further notice. In this case, the booked period will be made available again.
Continuation of the payment obligation
Cancellation of the booking due to non-payment does not release the end customer from their obligation to pay the contractually owed amounts. The outstanding claim shall continue to exist and can be asserted.
Assignment of claims
The provider and the platform reserve the right to assign outstanding claims to third parties in order to enforce payment. This may also include the transfer of the claim to debt collection agencies or lawyers.

Cancellation conditions are regulated in a separate section of this contract and apply independently of the payment conditions stated here.
